VitalityVice ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we have adopted the following policy to address claims of copyright infringement on our website, VitalityVice.com (the "Website").
1. Reporting Claims of Copyright Infringement
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our Website, please notify our designated Copyright Agent by providing a written notification (a "DMCA Notice") that includes the following information, as required by 17 U.S.C. § 512(c)(3):
- A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the URL or a specific description of the content).
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.
2. Submitting a DMCA Notice
Please send your DMCA Notice to our designated Copyright Agent at:
VitalityVice
Attn: Copyright Agent
Email:

We strongly recommend sending the notice via email for the fastest response. Incomplete or improper notices may not be processed.
3. Action Upon Receiving a DMCA Notice
Upon receiving a valid DMCA Notice, we will take the following actions:
- Promptly remove or disable access to the allegedly infringing material.
- Notify the user who posted the material (if identifiable) that it has been removed or disabled.
- Provide the user with an opportunity to submit a counter-notification (see below).
4. Counter-Notification Procedure
If you believe that your material was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our Copyright Agent. To be effective, a counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, the U.S. District Court for the District where VitalityVice operates), and that you will accept service of process from the person who provided the original DMCA Notice or their agent.
Send your counter-notification to the same Copyright Agent contact information listed above.
5. Action Upon Receiving a Counter-Notification
Upon receiving a valid counter-notification, we may restore the removed material or cease disabling access to it within 10-14 business days, unless the original complainant notifies us that they have filed a court action seeking to restrain the alleged infringement.
6. Repeat Infringer Policy
In accordance with the DMCA, we maintain a policy to terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. We may also limit or terminate access to our Website for any user who submits false or misleading DMCA Notices or counter-notifications.
7. Modifications to this Policy
We reserve the right to modify this DMCA Policy at any time. Any changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Website after such changes constitutes your acceptance of the revised policy.
